EMI ACCEPTABLE USE POLICY

This Acceptable Use Policy specifies the actions prohibited by Electronic Marketing, Inc. (EMI) to users of the EMI Network. EMI reserves the right to modify the Policy at any time, effective upon posting of the modified Policy.

ILLEGAL USE.
The EMI Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

SYSTEM AND NETWORK SECURITY.
Violations of system or network security are prohibited, and may result in criminal and civil liability. EMI will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:

Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network. Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP/IP packet header or any part of the header information in an email or a newsgroup posting.

SYSTEM AND NETWORK SECURITY. EMAIL.
Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site.

PREPAID ACCOUNTS.
Prepayment of services are non-refundable.

SYSTEM AND NETWORK SECURITY.
USENET, EMAIL, HOSTING.

Transmitting or relaying of unsolicited email via EMI or, any of EMI’s servers, or network is strictly prohibited. Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting, also known as "SPAM") is explicitly prohibited.

SYSTEM AND NETWORK SECURITY.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A EMI CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

TERMINATION OR MODIFICATION OF SERVICES.
Termination or modification of services will go in to affect at the end of the current billing cycle. EMI can elect to terminate services at anytime.

BEFORE YOU TRANSFER YOUR WEBSITE TO EMI BE SURE YOU HAVE A COPY OF YOUR WEBSITE ON YOUR LOCAL COMPUTER
EMI cannot and does not capture websites on behalf of clients. EMI will assist you in properly FTPing your web site on to the EMI web servers.

TERMS OF SERVICE.
Web sites, web servers and the Internet continue to evolve.EMI cannot make any warranties of service that scripts or services will continue to function after required updates to services. EMI has and will continue to make efforts to support and continue to provide service for legacy systems. Certain issues beyond EMI’s control make result in particular services not being able to be provided.

WARRANTY OF SERVICE.
Customer hold the Provider harmless against all claims, suits, costs, damages, judgments, loss of revenue, loss of business, attorney's fees, settlements or expenses incurred, claimed, obtained or sustained including third parties, whatever the cause of action including, without limitation, defamation, misappropriation, invasion of privacy, intellectual property infringement, or otherwise, whether such claims are meritorious or not, with regard to said customer web site, said email, other Internet related services. Customer must use programs that are supported by EMI for EMI to provide support. If EMI is not your access provider and you are experiencing difficulties, EMI may not be able to resolve issues for you.

INDEMINIFICATION.
The Customer shall indemnify and hold harmless Provider from any and all loss, cost, expense, and damage on account of any and all manner of claims, demands, actions, suits, proceedings, judgements, costs and expenses that may be initiated against Provider and Provider's officers, directors, and employees for any service provided to Customer by Provider to include web space content that violates any copyright, proprietary right of any person, state and federal regulations, or contains any matter that is libelous or scandalous.

CANCELATION.
The EMI billing department requires cancelation notices to be provided in writing either via fax transmission or via mail unless otherwise stated. Cancelations go into effect at the end of the current billing cycle.

EMI reserves the right to refuse service to anyone at anytime.
